Terms and Conditions
Booking:
The signing of the booking form confirms the acceptance of the terms and conditions set out below and shall be binding on all the persons intending to occupy the property whether or not such persons have signed the booking form. The Owners will confirm each booking as soon as possible after the signed booking form and deposit is received. The confirmation will be sent via email. The booking will be deemed confirmed at this point even if a deposit has not been drawn. Once the owners have issued the booking confirmation the signatory is responsible for the total price of the rental property as agreed (except where booking is cancelled more than 10 weeks from departure.) The remaining balance must be paid 10 weeks before departure. If the full balance is not paid 10 weeks prior to departure, we reserve the right to cancel your booking. The reservation deposit will be forfeited.
Booking Cancellations:
A cancellation must be received in writing or by e-mail (from the same e-mail address as the original booking was received by the owners).
In the event of a cancellation, 10 weeks or more before the start of the holiday, the deposit will be forfeited i.e. no refund is due.
In the event of a cancellation, less than 10 weeks before the start of the holiday, the signatory is liable for the full cost of the booking.
If a booking is cancelled the owners will re-advertise the villa for rent for this period. If the owners are successful re-letting some or all of the period, a refund for those days re-let will be made.
Security Deposit:
Upon signing the rental agreement the signatory agrees to pay for any damage of any kind to the property caused during their stay. An insurance policy at a cost of $45 will be offered to you at the start of your holiday by the Management Company. This is to cover the cost of accidental damage or loss to the value of $1500. Alternatively a $400 dollar deposit will be required by credit card, this will be fully refunded on satisfactory inspection of the property at the end of your stay. A loss that is greater than the value of the insurance or the deposit will be charged to your credit card.
In the event of any excess damage of any kind to the property or excess cleaning costs or excessive use of electricity, (e.g. leaving external doors open with air conditioning on) the signatory will be held responsible for all additional costs.
Liability:
The Owners and Management Company of the property accept no responsibility whatsoever for death, personal injury, accidents, loss or damage to persons or personal belongings however caused. The use of all accommodation and all amenities, including the pool is entirely at the users own risk. Children must be supervised at all times by responsible adults when using the swimming pool. GLASS is not permitted within the pool area. The Owners or Management Company cannot accept any liability for any loss of rental time due to travel problems, flight delays or cancellations, industrial disputes, or any events that are outside our control, including any form of Force Majeure.
Responsibilities:
The guests are responsible for the property, and are expected to take all reasonable care of it. At the end of the rental period, all equipment, including everything in the villa, all walls, all carpets and furnishings included, must be left clean and tidy.
Party Size:
Everyone occupying the property must be listed on the booking form, this includes small children. This is Florida state law and must be adhered to. The accommodation cannot be shared, assigned or sub-let and only the persons shown on the booking form are permitted to stay in the property. No pets are permitted. Persons under 21 years of age are not acceptable unless accompanied by parents or responsible adults. This property is fully licensed for short-term rental in Florida. The Owners reserve the right to refuse admittance if this condition is not met. Failure to comply will render the booking void and no compensation will be paid.
Arrivals and Departures:
The villa will be available for occupancy from 4.00pm on the day of arrival and must be vacated by 10.00am on the day of departure.
Smoking:
For the safety and comfort of all our guests and the preservation of our property smoking is not permitted within the property. Smoking in our villa will result in a £200/$400 charge to your credit card.
Code of Conduct:
Nothing should interfere with the quiet enjoyment of other holidaymakers and residents. Please do not play loud music, or do anything else which is likely to inconvenience your neighbours after 22.30pm or before 07.30am. In the event that anyone in your party behaves in a way which our Management Company believes is likely to cause danger, distress or annoyance to anyone else in surrounding areas, or damage any property on around our home, the Owners or their Management Company reserve the right to terminate your let immediately and forthwith. The Owners or their Management Company shall not be responsible for any costs you will occur, nor shall we pay any compensation, nor make any refunds due to this action.
Insurance:
It is a condition of this booking that all members of the party are covered by travel insurance, which carries adequate protection against delays and cancellation, and has adequate medical insurance for the U.S.A., and for luggage and personal belongings.
Force Majeure:
As with any other holiday, there may be circumstances completely beyond our control and contemplation, in which the property might not be available for your booking. Examples of these circumstances include but are not limited to destruction of, or severe damage to the property. Such circumstances are referred to as Force Majeure. In the event of Force Majeure, the Owners will do their best to make alternative arrangements for you where possible. If they cannot, or if alternative arrangements are unacceptable to you, then they will refund all monies paid. This will be the full extent of the Owners liability to you in such circumstances, and they shall not be responsible for any other costs connected with any such cancellation, howsoever arising.
Law:
This contract is subject to and shall be construed in accordance with the laws of the USA and all parties hereby submit to the exclusive jurisdiction of the Florida Courts.
Owner Access:
The Owner or their Management Company shall be allowed access at any reasonable time during your stay.
Complaints
In the unlikely event that you should have a problem with our home or its facilities please bring this to the attention of the Management Company immediately so they can investigate and attempt to resolve the issue locally. If you are still dissatisfied with the outcome, please send the complaint in writing to the management company within 14 days of your return home and send us a copy.
If you do not bring your complaint to the Management’s attention immediately, you will not have allowed them the opportunity to satisfactorily resolve your problem whilst being in the property. In these circumstances we will be unable to assist with your complaint. We cannot try to resolve things for you after you have returned home!
Please note that none of these provisions affect your statutory rights.
Please remember this is our home, not a hotel. Please treat the property as you would your own home. Thank you for your kind consideration.
